Parties and scope

These terms govern the relationship between the business using the Dokun digital loyalty software ("Service") ("Customer") and the provider named below ("Dokun"). The Service is intended for businesses (B2B). For card-holding end users only section 10 applies.

Account

The person opening the account confirms they are authorized to represent the business and that the details provided are accurate. The Customer is responsible for keeping login details and API keys confidential, for the permissions granted to staff accounts and for all activity in the account. Unauthorized use must be reported to Dokun immediately.

Subscription, renewal and cancellation

The Service is offered as a monthly or yearly subscription in the Starter, Growth and Pro plans. If no paid plan is chosen after the free trial, the dashboard becomes read-only. The subscription renews automatically at the start of each period until canceled. The Customer may cancel anytime from the dashboard; cancellation takes effect at the end of the paid period, with no partial refund. Upgrades apply immediately, downgrades from the next period.

Fees and payment

Fees are per location and shown on the payment screen in Turkish lira, VAT included. Payment is collected by card via iyzico. If a payment fails, a 3-day grace period applies, after which the dashboard becomes read-only. Price changes are announced by email at least 30 days before the new period; if the Customer does not accept, they may cancel at the end of the period. Invoices are sent by email.

Acceptable use

The Customer uses the Service lawfully and does not: forge stamps or rewards or mislead card holders; send commercial electronic messages without consent or IYS registration; use third-party trademarks, logos or personal data without authorization; probe the system's security, overload it, reverse-engineer it or try to circumvent API limits; publish harmful, obscene or unlawful content.

Suspension and termination

Dokun may suspend the account in whole or in part for non-payment, serious breach of these terms, security risk or an order by a competent authority. Where possible, notice is given in advance with reasonable time to cure. In case of serious or repeated breach the agreement may be terminated by notice.

Customer's responsibility towards card holders

The Customer sets the rewards and conditions of its loyalty program, provides the rewards and is the data controller for card holders' personal data. Providing privacy notices, obtaining consent, VERBIS and IYS registration where required, and answering card holders' requests are the Customer's responsibility. Dokun processes personal data only on the Customer's behalf under the Data Processing Agreement (/legal/dpa).

Data return and deletion

When the subscription ends, the account stays read-only for 30 days; during this time the Customer can export the customer list and transaction history as CSV from the dashboard. After this period, card holder data and business content are deleted or anonymized, including backups, within 90 days at the latest. Invoices and security logs subject to statutory retention are kept for the relevant period. Wallet cards stop updating.

Service level and outages

Dokun provides the Service with reasonable care and a commercially reasonable availability target; uninterrupted service is not guaranteed. Planned maintenance is announced in advance where possible. Dokun is not responsible for outages of third-party services such as Apple Wallet, notifications, SMS, email or payments. Service status can be followed on the status page linked in the site footer, if available.

For card holders

Card holders agree to use the Service lawfully, not to forge stamps and not to disrupt the system. Rewards and their conditions are set and provided by the business that issued the card; Dokun is not responsible for providing rewards.

Intellectual property

The software, design and trademarks belong to Dokun; the Customer receives a non-transferable, non-exclusive right of use for the subscription term. Logos, images and texts uploaded by the Customer remain the Customer's; Dokun uses them only to provide the Service.

Limitation of liability

Except where liability cannot be limited by law (intent and gross negligence), Dokun's total liability is limited to the subscription fees paid by the Customer in the 12 months before the event giving rise to the claim. Dokun is not liable for indirect damage, lost profit, data loss or loss of reputation. The Customer holds Dokun harmless from claims arising from its own program and obligations towards card holders.

Changes

Dokun may update these terms. Material changes to the Customer's detriment are announced by email and in the dashboard at least 30 days before they take effect; if the Customer does not accept, they may cancel at the end of the period. The current version is always published on this page.

Governing law and disputes

Turkish law applies. For disputes between merchants, the courts and enforcement offices of Istanbul (Central) have jurisdiction. If the Customer is a consumer, Consumer Arbitration Committees and Consumer Courts have jurisdiction under Law No. 6502. Notices are sent to the email registered in the account and to the contact addresses on this page.
